These General Terms and Conditions ("GTC") apply to all contracts between Dr. Peter Zoller, Hochriesstraße 31a, 83075 Bad Feilnbach (hereinafter: "Dr. Zoller") and consumers within the meaning of § 13 BGB (German Civil Code).
§ 1 SCOPE
(1) These GTC apply to all contracts between Dr. Zoller and consumers for the following services:
(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.
(3) Individual agreements always take precedence over these General Terms and Conditions. Individual agreements and any amendments, additions or cancellations to such agreements must be made in writing to be valid.
§ 2 CONCLUSION OF CONTRACT
(1) For online bookings, the customer submits a binding offer to conclude a contract by clicking on the "order with obligation to pay" or "book" button. The contract is concluded when the customer receives our confirmation by email and the seminar fee has been paid. The customer will receive the invoice together with the booking confirmation.
(2) In the case of written offers, the contract is concluded upon written acceptance by the customer. Subsidiary agreements must be made in writing.
(3) For all other booking procedures, e.g. by telephone, email, letter or fax, Dr. Zoller will send the customer an offer for the desired training course or seminar, which the customer can accept in writing within two weeks. Once the customer has confirmed their acceptance, the registration is binding for both parties and the customer will then receive an invoice.
(4) The customer will receive an order confirmation containing all essential contract details. All terms and conditions will be brought to the customer's attention in advance and sent by email after conclusion.
§ 3 DESCRIPTION OF SERVICES
(1) Coaching/mentoring:
One-on-one meetings, usually 60 minutes, conducted live. Focus on personal development, no knowledge transfer, no performance test, no certificate
(2) PQ® programme:
7-week intensive programme consisting of:
- 7 interactive video inputs (external content from Positive Intelligence)
- 7 live sessions with Dr Zoller (45-60 minutes each) on Monday evenings
- Use of the PQ® app for 1 year
- 1-4 additional coaching sessions
(3) Personality tests:
Online completion of the Gallup CliftonStrengths® test with subsequent evaluation.
(4) Some external digital services (e.g. PQ® video inputs, PQ® app) are provided by third-party providers, for whose availability and functionality Dr. Zoller takes no responsibility.
§ 4 PRICES AND PAYMENT
(1) The prices are final prices including statutory VAT and are clearly displayed before the contract is concluded.
(2) The prices include training services, training materials in German or English (depending on availability), lunch (for one-day training courses) and refreshments during breaks, unless otherwise stated. Other costs associated with the training, such as accommodation and travel expenses, shall be borne by the participant, unless otherwise agreed with the client. Non-attendance or only partial attendance at an event does not entitle the participant to a reduction in the participation fee.
(3) The customer will always be issued with an invoice, which can also be sent as a PDF file by email upon request.
(4) Payment is due immediately after invoicing, but no later than the start of the respective programme. If the participation fee has not been paid by the start of the event, participation is unfortunately not possible.
(5) An early bird discount is only granted if the booking and payment are made within the specified deadlines.
(6) In the event of late payment, interest on arrears of 5 percentage points above the base rate may be charged.
§ 5 DATES AND IMPLEMENTATION
(1) Dates are only binding if they have been confirmed in writing.
(2) In the event of unforeseeable circumstances (illness, force majeure), dates may be postponed. Alternative dates will be offered.
(2) Coaching appointments take place live (in person or online). No recordings are made.
§ 6 CANCELLATION BY THE CUSTOMER
(1) Cancellation policy outside the statutory right of withdrawal:
- Up to 28 days before the appointment: free of charge
- 27-15 days before the appointment: 50% of the fee
- In the event of a later cancellation, the entire participation fee will be charged.
(2) In the event of cancellation due to illness with a medical certificate, the customer has the right to rebook free of charge to a training course with the same course name on the next available date.
§ 7 LIABILITY
(1) Liability for damages shall only apply to damages resulting from intentional or grossly negligent breach of duty or culpable injury to life, limb or health by the user or one of its vicarious agents. Any further liability, in particular for damages caused by the participant himself or by third parties without any breach of duty on the part of the user or his vicarious agents, is excluded.
(2) We shall only be liable for simple negligence in the event of a breach of essential contractual obligations, limited to the foreseeable damage typical for this type of contract.
(3) No further liability is assumed for the content and functionality of external providers (PQ® app, third-party videos), except in the case of statutory provisions.
(4) Insofar as activities of external providers – such as climbing halls, swimming pools, sports facilities or comparable establishments – are carried out independently within the framework of the seminar programme, the user shall only be liable for its own fault in the selection and organisation of these providers. The user shall not be liable for damages arising in connection with the performance of such third-party services, unless injury to life, limb or health is based on an intentional or grossly negligent breach of duty by the user or its vicarious agents, or a material contractual obligation has been culpably breached. In all other respects, the statutory liability provisions shall apply. Participants are required to follow the instructions of the respective providers and to ensure that they behave responsibly and carefully during the activities.
(5) Liability under the Product Liability Act remains unaffected.
§ 8 DATA PROTECTION
(1) Personal data is processed in accordance with our privacy policy at www.peterzoller.de/datenschutz.
(2) In order to implement individual offers, personal data is transferred to third parties (e.g. providers of the PQ app or Gallup Inc. for personality tests) in accordance with the privacy policy.
§ 9 COPYRIGHT
(1) All materials and content provided by Dr. Zoller are subject to copyright.
(2) Any transfer, reproduction or publication without written permission is strictly prohibited.
§ 10 DISPUTE RESOLUTION
(1) We are not obliged to participate in consumer arbitration proceedings.

§ 11 FINAL PROVISIONS
(1) German law applies.
(2) Should individual clauses be invalid, the validity of the remaining clauses shall remain unaffected.
